Was the driver on the clock?
A company is generally responsible for crashes its employees cause while doing their jobs. The hard part is proving they were.

The basic rule
In Georgia, an employer is generally responsible when an employee causes harm while acting within the scope of the job and in furtherance of the employer's business.
| Situation | Usually treated as… |
|---|---|
| Making a delivery or driving to a job site during work | Working |
| Driving a company vehicle between work stops | Often working |
| Ordinary commute to and from work | Often not working, with exceptions |
| A personal errand in a company vehicle | Depends on the facts |
General patterns only. Each case turns on its facts.
Careless hiring, training or supervision
Separate from the employee's driving, a company can be responsible for its own mistakes: hiring a driver with a bad record, skipping training, or ignoring complaints.
How we prove it
- Dispatch logs, route data and GPS records
- Time cards and job tickets
- The company's policies about vehicle use
- What the driver said at the scene
